These Terms and Conditions ("Terms") govern your access to and use of the Poolified website, platform, and services operated by Poolified Pty Ltd ("Poolified", "we", "us", or "our"). By creating an account, submitting a brief, listing an item, or otherwise using our platform, you agree to be bound by these Terms.
Please read these Terms carefully before using the platform. If you do not agree with any part of these Terms, you must not use the platform.
Poolified operates a two-sided platform that:
Poolified is not a party to any transaction, contract, or agreement between homeowners, builders, buyers, or sellers facilitated through the platform. We provide the platform infrastructure and related services only.
You must be at least 18 years of age to create an account. By creating an account, you represent that you are 18 years or older and that you have the legal capacity to enter into a binding agreement.
You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date. Poolified reserves the right to suspend or terminate accounts where information is found to be false, misleading, or incomplete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at admin@poolified.com if you become aware of any unauthorised use of your account.
Each individual or business entity may maintain only one account. Creating duplicate accounts to circumvent suspensions or restrictions is prohibited.
The Quote Engine allows Homeowners to submit a pool brief describing their project requirements. Poolified uses this brief to identify and notify matched Builders from the panel. Builders may then choose to unlock the brief to access the Homeowner’s full contact details.
The Quote Engine service is provided free of charge to Homeowners. Poolified does not charge Homeowners for submitting briefs, receiving quotes, or using any other homeowner features of the platform.
Poolified does not guarantee that any brief will receive a response, or that any particular number of Builders will unlock or respond to a given brief. The availability of Builders varies by location, budget, and project type.
By submitting a brief, you confirm that:
Receiving quotes through the Quote Engine does not create a binding contract between you and any Builder. A formal written contract between the Homeowner and Builder must be prepared and signed before any works commence or deposit is paid.
Briefs remain active for 30 days from the date of submission, or until all available builder slots are filled, whichever occurs first. Expired briefs are automatically closed and cannot be re-opened.
Builders must apply for and be approved for panel membership. Approval is at Poolified’s sole discretion. To be eligible, Builders must hold a current, valid licence in their state or territory, hold adequate public liability insurance, and meet any other requirements specified by Poolified from time to time.
Poolified verifies Builder licences and insurance at the time of onboarding and at regular intervals thereafter. Builders must promptly notify Poolified of any change in their licence or insurance status. Providing false or outdated documentation is grounds for immediate termination.
Builders pay a non-refundable fee to unlock each Brief they wish to respond to. The fee is charged to the Builder’s nominated payment method at the time of unlock. Unlock fees are displayed clearly before payment is confirmed and vary based on the Homeowner’s stated budget band.
Brief unlock fees are non-refundable once the Homeowner’s contact details have been revealed, regardless of whether the Builder is able to contact the Homeowner, arrange a site visit, or win the job. By confirming an unlock, the Builder accepts the non-refundable nature of the fee.
Panel membership is charged monthly or annually as selected at the time of subscription. Fees are charged in advance. Poolified reserves the right to amend membership fees with 30 days’ written notice. Continued use of the platform after the effective date of a fee change constitutes acceptance of the new fees.
Builders who unlock a brief agree to:
Poolified is not a party to any building contract between a Builder and Homeowner. Poolified does not supervise, guarantee, or take responsibility for the quality or outcome of any pool build. The Builder-Homeowner relationship is entirely independent of Poolified.
Sellers are responsible for ensuring that their Listings are accurate, not misleading, and comply with all applicable Australian laws, including the Australian Consumer Law. Sellers must own or have the right to sell the items listed, and must honour transactions entered into in good faith.
The following may not be listed on the Marketplace:
Poolified is an advertising platform. We do not verify the accuracy of Listings, inspect goods prior to listing, or take possession of any goods or funds. All transactions are between Buyers and Sellers. Poolified is not a party to any sale.
Buyers are responsible for conducting their own due diligence before purchasing. Poolified strongly recommends inspecting all items before paying. Poolified accepts no liability for loss arising from Marketplace transactions.
Sellers may list one item free of charge on the Free plan. Additional listings or enhanced features require a paid subscription. Subscription terms are as set out on the pricing page and may be updated from time to time with 30 days’ notice.
All payments are processed by Stripe. By providing payment details, you agree to Stripe’s terms of service. Poolified does not store full credit card details on its servers.
All prices are in Australian dollars (AUD) and include GST where applicable. Poolified will provide a tax invoice for all charges.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period — access continues until then.
By submitting Content to the platform (including listing photos, brief descriptions, or profile information), you grant Poolified a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that Content for the purpose of operating and promoting the platform.
You are solely responsible for all Content you submit. You represent that your Content does not infringe any third-party intellectual property rights, is not defamatory or unlawful, and does not contain malware or harmful code.
Poolified reserves the right to remove any Content that, in our reasonable opinion, violates these Terms or is otherwise objectionable, without notice or liability.
You must not use the platform to:
All intellectual property in the Poolified platform, including its design, software, trade marks, logos, and content created by Poolified, is owned by or licensed to Poolified Pty Ltd. Nothing in these Terms grants you any right to use Poolified’s intellectual property except as expressly permitted.
Poolified collects and handles personal information in accordance with our Privacy Policy, available at www.poolified.com/privacy. By using the platform, you consent to the collection and use of your personal information as described in the Privacy Policy.
The platform is provided on an "as is" and "as available" basis. Poolified makes no warranties, express or implied, regarding the availability, reliability, accuracy, or fitness for a particular purpose of the platform.
Poolified does not warrant the conduct, quality, or reliability of any Builder, Seller, or Buyer on the platform. User ratings and verified badges indicate that certain checks have been performed at a point in time, but do not constitute a guarantee of future conduct or quality of work.
To the maximum extent permitted by law, Poolified’s liability to you for any loss or damage arising from or in connection with the platform (whether in contract, tort, or otherwise) is limited to the greater of:
Poolified is not liable for any indirect, special, incidental, consequential, or punitive loss or damage, including loss of profits, data, goodwill, or business opportunity.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law, to the extent that it cannot be lawfully excluded or restricted.
You agree to indemnify and hold harmless Poolified, its officers, employees, and agents from any claim, loss, damage, liability, or expense (including legal fees) arising from:
Poolified may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or if required to do so by law.
You may close your account at any time by contacting admin@poolified.com. Upon closure, your access to the platform will cease and your data will be handled in accordance with our Privacy Policy and applicable law.
Poolified may modify the platform, add or remove features, or update these Terms at any time. We will notify you of material changes to these Terms by email or by displaying a notice on the platform. Your continued use of the platform after the effective date of any update constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Queensland, Australia. You and Poolified submit to the exclusive jurisdiction of the courts of Queensland.
Before commencing legal proceedings, the parties agree to attempt to resolve any dispute in good faith through direct negotiation. If unresolved after 30 days, either party may refer the matter to mediation administered by an agreed mediator, before commencing litigation.
These Terms constitute the entire agreement between you and Poolified regarding your use of the platform and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, it will be severed without affecting the remainder.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.
You may not assign your rights or obligations under these Terms without our written consent.
